Our client, Angel Acevedo, whose daughter Yvette lives at an Episcopal Social Services group home in East Harlem, recently filed a $10 million lawsuit against the agency for sexual abuse while in their care. July 15, 2010Appeals Court Limits Film Footage Turnover Order in Chevron v. Berlinger (Rainforest) Case
Late yesterday, a three-judge panel of the US Court of Appeals for the Second Circuit modified a lower court order that had required our client, the award-winning documentary filmmaker Joe Berlinger, to turn over all of his raw film footage from CRUDE to Chevron Corp. The lower court order would have required Berlinger to produce more than 600 hours of raw film footage. Under yesterday’s appeals court order, Berlinger would produce only unused footage that falls into three narrow categories. While we await the appeals court’s formal legal opinion on the journalist’s privilege, the interim order substantially limits Judge Kaplan’s over-reaching decision and places restrictions on Chevron (i.e., the company may not use any footage we ultimately produce in their PR efforts).  The New York Times, The Los Angeles Times, Wall Street Journal, Law.com, The New York Law Journal and The Wrap covered the story here, here, here, herehere and here.

A three-judge panel of the US Court of Appeals for the Second Circuit ruled today that the award-winning documentary filmmaker Joe Berlinger will get a full hearing in July on his appeal from the lower court decision that had ordered him to turn over more than 600 hours of raw film footage to Chevron Corporation. The lower court’s May 20th order directing Berlinger to produce the footage will be stayed during the pendency of the appeal. “Today’s decision signals that the appeals court takes seriously the rights of investigative journalists like Joe Berlinger,” said Maura Wogan of Frankfurt Kurnit, the lawyers for Mr. Berlinger and his production company. On May 10th Judge Kaplan of the District Court for the Southern District of New York ordered the award-winning filmmaker Joe Berlinger to turn over to Chevron Corp. more than 600 hours of unused film footage from his documentary CRUDE, which is about damage to the Ecuadorean rainforest and the attendant, decades-long litigation. In light of this decision, several prominent entertainment groups and individual artists, including well-known Academy Award winners, have signed on to open letters of support. Groups supporting Berlinger's First Amendment position include the International Documentary Association (IDA), the Directors Guild of America, and The Writers Guild of America.
